Kenneth Buzzard was convicted of second degree murder. He was sentenced to the custody of the Board of Correction for an indeterminate period not to exceed twenty years. On direct appeal, we affirmed the judgment of conviction. State v. Buzzard, 110 Idaho 800, 718 P.2d 1238 (Ct.App.1986) (hereinafter cited as Buzzard I). In that appeal, Buzzard did not raise any issue with regard to his sentence. He later filed a motion under Idaho Criminal Rule 35, seeking reconsideration of his sentence. That motion was denied by the district court after a hearing. Buzzard appeals again, contending the denial of his Rule 35 motion was an abuse of the courts discretion. We affirm.
