PERRY, J. Larry Naccarato entered a conditional plea of guilty before the magistrate, pursuant to I.C.R. 11(a)(2), to a charge of driving
under the influence. I.C. § 18-8004. He appealed from his judgment of conviction, having reserved the right to contest
